Eliseo Aja was a professor of constitutional law at the University of Barcelona, whose field he joined, then political law, in the early 1970s to join the chair of Manuel Jiménez de Parga and, shortly after, to collaborate with Jordi Sole. Tura, with whom he developed a collaboration and a friendship that lasted until his crime and which still enjoy today those who begin with his “Constitutions and Constituent Periods in Spain 1808-1936” in the Constitutional History of the ‘Spain. . Eliseo Aja and Miguel Donde Aparicio spent more than forty years working as professors in Lleida, which he will always remember fondly, building what is now the UB’s Constitutional Law Section, making it his home and that of all those associated with it. thanks to him, we learned to flirt with university work.
As a young assistant, as a grateful teacher or as an emeritus, those who have taken Eliseo Aja’s classes always remember the energy and passion with which he was able to arouse their interest, the sharpness with which he found the keys to understanding politics – the constitution of ingenuity and the basic principles for its approval or transformation.
The same energy and the same passion have generated and shaped so many academic and scientific projects and initiatives, always distinguished by their connection with the political-institutional ingenuity of our country, by their brilliant capacity for diagnosis and by their propensity to influence and modify ingenuity. . From the work on the constitutive moment, still alive in its presentation to Ferdinand Lassalle’s classic study What is a Constitution, to his teaching on the dissection of the autonomous state, summarized in the volume that continues to to be the best dissection of our model territory “Autonomous State and Federal Reform” or its commitment to foreigners and immigrant rights, which in the first decade of this century gave rise to “Immigrant Rights in Spain”.
All these works and so many others by him stand out for their extremely abundant character beyond his interest: undoubtedly fruitful in suggestion and in influencing political and institutional enthusiasm; no scholar was beyond pure, aseptic research in his ivory tower; but above all fruitful in the formation of teams, knowing how to combine different visions and offering results thanks to the competition of arguments, their debate and their integration, also in the press and before public opinion.
Above all, Eliseo was an excellent team builder. I have never met someone with his attractiveness and his capacity for persuasion and ticket, with his understanding to listen to everyone and collect their contributions, and with his detachment to propose his own and transform his initiatives into shared and collaborative projects, and that he always wanted her survived him. . This is also the case of the Chronicle of the Autonomous Communities which, with its dissection and annual evaluation of the Autonomous State, is probably the oldest scientific initiative of our well-known law; This was achieved with the groups of professors he initiated and integrated into the study of immigration law; as well as lawyers and friends whom he has always wanted and been able to associate with his projects, in whose name he would like to write these memoirs; and that is exactly what he wanted for the project he promoted with the most energy, the Observatory of the Institute of Known Law of the University of Barcelona.
Others have been able to excel in the rigor and thoroughness of their studies or to inaugurate unknown grounds for forensic investigation and dissection. Instead, Eliseo was the passionate lawyer who immersed himself in the debates of our time and knew how to approach their dilemmas, expressing the necessary overview, offering solutions and proposing possible alternatives with the commitment the most. more sincere.
Eliseo and his works are also the best example of confidence in the law: in its capacity to act on ingenuity, in its susceptibility to reasoned criticism, in its power of endorsement and in its power of transformation; for the benefit of the community, as power born of debate, agreement and pact. Because by his commitment and the solidity of his titles, he has always reminded that in a democratic society, the law, which always arises in confrontation and integration with the other, is the best tool for coexistence and political integration. that he was able to practice between 2009 and 2013 first president of the Council of Legal Guarantees of Catalonia.
Until a few weeks ago, its always bright and penetrating stars shone at the mention of this law school, never ideally and always in concrete conflicts. Without crisis, not as brilliant as with Anna and Júlia, who gave him so much joy and from whom he drew so much strength, always and in his last months.
